TERMS & CONDITIONS
Last updated 20 June 2026
These Terms & Conditions govern your use of theeveafterdark.co.uk and any order you place with Eve After Dark ("we", "us", "our"). By placing an order with us, you agree to these terms. Please read them carefully. If you do not agree, please do not use our website or place an order.
1. Ordering
You can place a food order for delivery or pickup through our website. Add items to your basket, choose delivery or pickup, enter your contact details (and your address, for delivery), and pay securely by card. Your order is accepted and binding once your payment has been confirmed and you have received an order confirmation on screen and by email. Bulk and catering orders are arranged directly with us by phone or WhatsApp. We reserve the right to refuse or cancel any order at our discretion — for example, if items are unavailable, if we cannot deliver to your area, or if we suspect fraudulent activity. If we cancel an order you have already paid for, you will receive a full refund.
2. Pricing
All prices are shown in pounds sterling (GBP) and include VAT where applicable. We aim to keep all prices accurate, but errors can occasionally occur. If we discover a pricing error after you order, we will contact you to confirm whether you wish to proceed at the correct price. The delivery charge for your address is calculated and shown to you before you pay. Payment is taken in full at the time of ordering by card through our payment provider, Stripe.
3. Availability
All food and menu items are subject to availability. Because our dishes are freshly prepared, certain items may sell out or be unavailable at busy times. If an item you have ordered is unavailable, we will contact you to offer an alternative or a refund for that item.
4. Allergens
Our food is prepared in a kitchen that handles a range of ingredients, including known allergens such as nuts, peanuts, milk, eggs, fish, crustaceans, molluscs, soya, sesame, mustard, celery, gluten and sulphites. As a result, we cannot guarantee that any dish is completely free from any allergen due to the risk of cross-contamination. If you have a food allergy or intolerance, please tell us before you order so we can advise you. It remains your responsibility to make us aware of any allergies, and you order with that understanding.
5. Delivery
We deliver to addresses within a set distance of our kitchen; if your address is out of range you will be told before you pay. Deliveries are carried out by our delivery partner, MealShift, whose driver collects your order from our kitchen once it is ready. You will receive a tracking link by email. Delivery times are estimates and may vary depending on demand, weather, traffic and kitchen volume. Please ensure the delivery address and contact number you provide are accurate, and that someone is available to receive the order. If we are unable to deliver because of incorrect details or because no one is available, we may not be able to offer a refund. Risk in the food passes to you on delivery.
6. Collection
You can choose to collect your order from our kitchen at 485 Kingsland Road, London E8 4AU instead of having it delivered. Pickup orders are paid by card when you order and have no delivery charge. Your food will be ready about 45 minutes after your payment is confirmed; the exact time is shown on screen and in your confirmation email. Please collect promptly to enjoy it at its best. To collect a bulk or catering order, please arrange it with us directly by phone or WhatsApp and we will let you know when it is ready.
7. Cancellations
Because our food is freshly prepared to order, you may only cancel an order before preparation has begun. To request a cancellation, contact us as soon as possible by phone or WhatsApp. Once we have started preparing your order, it can no longer be cancelled. Please see our Refund & Cancellation Policy for full details.
8. Refunds
As food is a perishable product, refunds are limited and are offered only in specific circumstances — such as where the wrong order is delivered, food is not delivered, food arrives unsafe to consume, or there are significant quality issues. Full details, including how to make a claim, are set out in our Refund & Cancellation Policy.
9. Customer Responsibilities
When ordering from us, you agree to:
- Provide accurate, complete and up-to-date contact and delivery information;
- Inform us of any allergies, intolerances or dietary requirements before ordering;
- Be available to receive your delivery, or to collect your order on time;
- Be the legal age required to purchase any age-restricted items;
- Treat our staff and delivery drivers with respect;
- Not use our website or services for any unlawful or fraudulent purpose.
10. Liability
We take great care in preparing and delivering your food. To the fullest extent permitted by law, our liability for any order is limited to the value of that order. We are not liable for losses that are not reasonably foreseeable, or for issues caused by circumstances beyond our reasonable control. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under UK law. Your statutory rights as a consumer are not affected.
11. Intellectual Property
All content on this website — including the Eve After Dark name and logo, text, photography, graphics, menus and design — is owned by or licensed to Eve After Dark and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any of our content for commercial purposes without our prior written permission.
12. Governing Law
These Terms & Conditions and any dispute arising from them are governed by the laws of England & Wales, and the courts of England & Wales will have exclusive jurisdiction.
